Elder abuse

Elder abuse is a growing problem in the western world.

In Australia there have been a number of instances of children expending all of their parent’s funds or mortgaging their homes without their knowledge, thereby imperilling their future.

NSW solicitors whom have been appointed as power of attorney have discovered that children of their clients have used ATM cards to withdraw substantial amounts of funds resulting in the nursing home fees being in arrears.

In Ireland social workers report that hospitals wanting to transfer patients to nursing homes are stymied by their children whom reside in the family home and do not wish to either sell or encumber same so as to facilitate the payment of the nursing home entry fees.

Further problems are experienced at probate when the issue of notional estate is raised and the prospect of pursuing family members for funds or assets is canvassed.
